This Grant Application Form is submitted by (“you” or “your”, as applicable)

Please note that the “Shared Definitions” - The Emerging Technology Association Shared Definitions (the “Shared Definitions”), available at httpss://www.emergingte.ch/policies (or such other Internet URL as ETA may determine from time to time), are hereby incorporated herein by this reference and made a part hereof. Any capitalized terms not defined herein shall have the meanings set forth in the Shared Definitions.

By submitting this Grant Application you confirm that you are familiar with the Program Material as defined in the Program Terms, have read, understood, and agreed to be bound by the Program Associate Agreement, any applicable Grant Agreement, and the Policies (including but not limited to the Program Terms).

By submitting this Grant Application, you acknowledge and agree that the approval of your Grant Application is at the sole discretion of ETA. No one is obligated to explain to you why your Grant Application was or was approved. There is neither a right for you to be accepted as a Grant Recipient nor do you have the right to claim a Grant. You will not be compensated for submitting this Grant Application, outlining your project to ETA, or organizing and submitting any other documents required under the Program for the Grant Application. The following details will help us to evaluate your proposed Project Plan. Therefore, may we kindly ask you to provide the requested information in the form below.



Warrant and Signature *

You herewith warrant and represent that all the information provided is true, complete, accurate, and not misleading as of the date hereof and that you will immediately inform ETA if this changes.

By submitting this Grant Application, you further acknowledge and agree that ETA currently does not have sufficient funds in order to fulfill the milestone payments in accordance with your Project Plan. There is a substantial risk that you will not be compensated for your work under the proposed Project Plan.

Any payment obligation of ETA is subject to the receipt of funding of at sufficient funds. ETA will notify you as soon as the sufficient funding is received. Furthermore, ETA will publicly publish its financial statements. If this clause is rendered void, illegal or unenforceable by any legislation to which it is subject, it shall be rendered void, illegal or unenforceable to that extent and no further and, for the avoidance of doubt, the following shall apply:

You explicitly agree that the Grant payouts shall become due as soon as ETA has received funding. From the date on which you sign the Grant Agreement until the day ETA receives funding, all due claims are subject to a stay of enforcement (in German: Stundung). Such stay is not a suspension of payments within the meaning of the Debt Collection and Bankruptcy Act of 11 April 1889; you may not apply for the commencement of insolvency proceedings without prior debt enforcement. ETA will notify you as soon as the funding has been received. Furthermore, ETA will publicly publish its financial statements.

You hereby release and discharge ETA together with their respective directors, officers, employees, agents from all known and unknown charges, complaints, claims, liabilities, obligations, promises, damages, actions, losses of any nature whatsoever, known or unknown whether or not apparent or yet to be discovered, or which may hereafter develop, for any acts or omissions related to or arising from the fact that ETA currently does not have sufficient funds in order to fulfill the milestone and Grant payments in accordance with your Project Plan and the related substantial risk that you will not be compensated for your work under the proposed Project Plan or Grant Agreement or Grant Agreement.

This Grant Application shall be governed by, and construed in accordance with, the laws of Switzerland. Any dispute arising out of or in connection with this Grant Application shall be referred to and finally resolved by the ordinary courts in Zug, Switzerland.
